TERMS OF USE

Effective Date: August 20, 2026

These Terms of Use ("Terms") govern your access to and use of Volley AI, including the Volley AI mobile application, website, features, content, and related services (collectively, the "Service").

Volley AI is operated by Jeytex LLC ("Jeytex," "Volley AI," "we," "us," or "our").

By creating an account, purchasing a subscription, or otherwise using Volley AI, you agree to these Terms. If you do not agree to these Terms, do not use the Service.

1. ABOUT VOLLEY AI

Volley AI provides technology-assisted volleyball coaching tools, including features that may allow users to:

• Upload or select volleyball videos for analysis
• Receive AI-generated technique feedback
• Receive scores, observations, coaching suggestions, and areas of focus
• Review previous analysis reports
• Track progress over time
• Receive recommended volleyball drills or training resources
• Maintain an athlete profile
• Record training activity and streaks
• Access other volleyball training and development features

Features may change, be added, or be removed over time.

2. ELIGIBILITY

You must be legally permitted to use the Service in your country or region.

If you are under the age of majority where you live, you may use Volley AI only with the permission and supervision of a parent or legal guardian.

Volley AI is not intended for children under 13 unless use is expressly permitted by applicable law and appropriate parental consent has been obtained.

If you are a parent or legal guardian allowing a minor to use Volley AI, you are responsible for the minor's use of the Service.

3. ACCOUNTS

Some features require a Volley AI account.

You agree to:

• Provide accurate information
• Keep your login credentials secure
• Not share your password with unauthorized users
• Notify us if you believe your account has been compromised
• Be responsible for activity that occurs through your account

You may not impersonate another person, create accounts for fraudulent purposes, or use another person's account without authorization.

We may suspend or terminate accounts that violate these Terms or create a security, legal, or operational risk.

4. AI-GENERATED ANALYSIS AND COACHING

Volley AI uses artificial intelligence and other automated systems to analyze certain volleyball videos and generate coaching-related information.

AI-generated results may include:

• Technique scores
• Observed strengths
• Potential weaknesses
• Suggested areas of focus
• Coaching explanations
• Drill recommendations
• Progress insights

AI-generated analysis is not guaranteed to be accurate, complete, or appropriate for every athlete.

Factors such as camera angle, video quality, lighting, athlete visibility, frame selection, movement complexity, and limitations of artificial intelligence may affect the quality of an analysis.

You should use Volley AI as an informational and training aid, not as the sole basis for athletic, health, medical, or safety decisions.

5. NOT MEDICAL OR PROFESSIONAL HEALTH ADVICE

Volley AI is not a medical service.

Nothing provided through Volley AI is intended to diagnose, treat, cure, or prevent an injury, illness, or medical condition.

The Service is not a replacement for advice from:

• Physicians
• Physical therapists
• Athletic trainers
• Other licensed healthcare professionals

If you experience pain, injury, dizziness, unusual discomfort, or another health concern, stop the relevant activity and seek appropriate professional guidance.

You are responsible for determining whether any training activity is appropriate for you.

6. ATHLETIC RESULTS

Volley AI does not guarantee:

• Improved volleyball performance
• Increased athletic ability
• Team placement
• Scholarships
• Recruiting opportunities
• Injury prevention
• Specific performance improvements
• Any particular athletic outcome

Individual results vary.

7. USER VIDEOS AND CONTENT

You may provide videos, images, profile information, training information, or other content to Volley AI ("User Content").

You retain ownership of your User Content.

By providing User Content to the Service, you grant Jeytex a limited, non-exclusive license to process, store, transmit, reproduce, and otherwise use that content as reasonably necessary to provide, maintain, secure, and improve the Service, subject to our Privacy Policy.

This permission does not transfer ownership of your content to Jeytex.

You represent that you have the necessary rights and permissions to upload or use any content you provide.

Do not upload content that:

• Violates another person's privacy
• Infringes copyrights or other intellectual property rights
• Was obtained unlawfully
• Contains illegal material
• You do not have permission to use

If a video includes another person, you are responsible for ensuring that you have any permissions reasonably required to upload and analyze that video.

8. VIDEO STORAGE AND AVAILABILITY

Some Volley AI features may associate analysis reports with videos stored locally on a user's device.

Locally stored videos may not be available after events such as:

• Uninstalling the application
• Deleting the original file
• Changing devices
• Clearing application data
• Operating-system storage cleanup
• Device failure

A saved analysis report may remain available even if the original local video is no longer available.

Any additional storage, processing, or handling of information is described in our Privacy Policy.

9. ANALYSIS HISTORY AND ARCHIVING

Volley AI may allow users to save, view, archive, and restore previous analysis reports.

Archiving a report does not necessarily delete it.

Archived reports may remain accessible while being excluded from current progress calculations, coaching insights, training recommendations, or other analytics.

Restoring a report may allow it to contribute to those features again.

10. TRAINING AND DRILL RECOMMENDATIONS

Volley AI may recommend volleyball drills, exercises, videos, or training resources based on analysis results or athlete information.

You are responsible for deciding whether a drill or training activity is appropriate and safe for you.

Training recommendations are informational and are not a guarantee of safety or effectiveness.

Where third-party videos or resources are provided, those resources are controlled by their respective owners and may become unavailable or change without notice.

11. SUBSCRIPTIONS AND PAID FEATURES

Some Volley AI features require a paid subscription.

Available subscription options, prices, trial periods, billing frequency, and included features will be displayed before purchase.

Depending on your device, platform, or purchase method, subscriptions may be processed by:

• Apple App Store
• Google Play
• Stripe
• Another authorized payment provider

Prices may vary by country, platform, taxes, currency, promotions, or payment provider.

12. AUTOMATIC RENEWAL

Unless otherwise stated at the time of purchase, paid subscriptions automatically renew until canceled.

Your subscription provider may charge your selected payment method at the beginning of each renewal period.

You are responsible for canceling before the applicable renewal date if you do not want your subscription to renew.

13. FREE TRIALS

Volley AI may offer free trials to eligible users.

Trial availability, duration, and eligibility may vary.

Unless canceled before the end of the trial, a trial may automatically convert to a paid subscription at the price presented when you began the trial.

A user may not necessarily be eligible for multiple free trials.

14. CANCELLATION

You may cancel a subscription through the provider used to purchase it.

For example:

• Apple subscriptions may be managed through your Apple account
• Google Play subscriptions may be managed through Google Play
• Stripe subscriptions may be managed through the billing options provided by Volley AI

Cancellation generally prevents future renewal but does not necessarily terminate access immediately.

You may continue to receive paid access through the end of the already-paid subscription period, subject to the applicable provider's rules.

15. EXPIRED SUBSCRIPTIONS AND SAVED DATA

If your paid subscription expires, Volley AI may restrict access to features that create new paid services, including new AI-powered analysis.

Expiration does not necessarily delete previously created information.

Depending on the features available at that time, you may continue to access previously saved items such as:

• Analysis reports
• Analysis History
• Archived reports
• Athlete profile information
• Progress information derived from existing analyses
• Training activity
• Other previously generated data

We may change which features are available on free and paid plans in the future.

16. REFUNDS

Payments processed through Apple, Google, Stripe, or another payment provider may be subject to that provider's refund policies.

Where required by law, we will provide refunds or remedies required by applicable consumer-protection laws.

Except where required by law or applicable platform rules, fees already paid may be non-refundable.

17. THIRD-PARTY SERVICES

Volley AI may rely on or interact with third-party services, including services related to:

• Artificial intelligence
• Authentication
• Cloud infrastructure
• Payments
• Subscription management
• Video hosting
• Training resources
• Analytics
• App distribution

Third-party services may have their own terms and privacy practices.

We are not responsible for third-party services that are outside our control.

18. INTELLECTUAL PROPERTY

Volley AI, Jeytex, and their associated software, branding, graphics, designs, interfaces, text, technology, and original content are owned by Jeytex LLC or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted, you may not:

• Copy the Service
• Reverse engineer the Service
• Sell or sublicense access to the Service
• Remove proprietary notices
• Use Volley AI branding without authorization
• Reproduce substantial portions of proprietary Volley AI content
• Attempt to obtain source code except where applicable law expressly permits it

Nothing in these Terms transfers ownership of Jeytex intellectual property to you.

19. ACCEPTABLE USE

You agree not to use Volley AI to:

• Break applicable laws
• Harm, threaten, harass, or exploit another person
• Upload unlawful or unauthorized material
• Attempt unauthorized access to accounts, servers, or systems
• Circumvent subscription or access controls
• Abuse, overload, or interfere with the Service
• Use automated systems to scrape or extract the Service without permission
• Introduce malware or malicious code
• Fraudulently manipulate accounts, trials, payments, or subscriptions
• Use the Service in a way that infringes another person's rights

20. SERVICE AVAILABILITY

We work to keep Volley AI available, but we do not guarantee uninterrupted access.

The Service may occasionally be unavailable because of:

• Maintenance
• Updates
• Network problems
• Third-party outages
• Security events
• Technical failures
• Events beyond our reasonable control

We may change or discontinue portions of the Service.

21. BETA, EXPERIMENTAL, AND NEW FEATURES

Some features may be identified as beta, experimental, preview, or otherwise under development.

Such features may:

• Change without notice
• Contain errors
• Be temporarily unavailable
• Produce incomplete or inaccurate results
• Be removed

22. ACCOUNT TERMINATION

You may stop using Volley AI at any time.

Where account deletion functionality is available, you may request deletion through the app or our published account-deletion process.

We may suspend or terminate access if we reasonably believe:

• You violated these Terms
• Your use creates a security risk
• Your use is fraudulent or unlawful
• Suspension is required by law
• Continued access could harm Volley AI, Jeytex, other users, or third parties

Certain provisions of these Terms may continue to apply after termination where appropriate.

23. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOLLEY AI IS PROVIDED "AS IS" AND "AS AVAILABLE."

JEYTEX DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.

WE DO NOT WARRANT THAT:

• AI ANALYSIS WILL ALWAYS BE ACCURATE
• THE SERVICE WILL ALWAYS BE AVAILABLE
• THE SERVICE WILL BE ERROR-FREE
• TRAINING RECOMMENDATIONS WILL PRODUCE A PARTICULAR RESULT
• THE SERVICE WILL IDENTIFY OR PREVENT INJURY
• ALL SAVED OR LOCALLY STORED CONTENT WILL ALWAYS REMAIN AVAILABLE

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

24. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JEYTEX LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF VOLLEY AI.

THIS MAY INCLUDE DAMAGES ARISING FROM:

• LOSS OF DATA
• LOSS OF PROFITS
• LOSS OF OPPORTUNITY
• ATHLETIC PERFORMANCE
• RELIANCE ON AI-GENERATED INFORMATION
• SERVICE INTERRUPTIONS
• THIRD-PARTY SERVICES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JEYTEX'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO JEYTEX FOR VOLLEY AI DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
(B) $100 USD.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

25. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Jeytex LLC and its affiliates, owners, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• Your unlawful use of the Service
• Your violation of these Terms
• Your User Content
• Your infringement of another person's rights

This section does not apply where prohibited by applicable consumer law.

26. PRIVACY

Your use of Volley AI is also governed by the Volley AI Privacy Policy:

The Privacy Policy explains how information is collected, used, stored, and handled.

27. APP STORE AND PLATFORM TERMS

If you download or purchase Volley AI through a third-party app marketplace, your use may also be subject to that marketplace's terms.

For example, Apple App Store users remain subject to applicable Apple terms, and Google Play users remain subject to applicable Google Play terms.

If there is a conflict between these Terms and mandatory platform requirements, the applicable platform requirement will control to the extent required.

Apple, Google, and other platform providers are not responsible for providing Volley AI's support services unless their own terms state otherwise.

28. CHANGES TO THESE TERMS

We may update these Terms from time to time.

When we make changes, we may update the Effective Date above and provide additional notice where required by law or where changes are material.

Your continued use of Volley AI after updated Terms become effective constitutes acceptance of the updated Terms where permitted by law.

If you do not agree to updated Terms, you should stop using the Service.

29. GOVERNING LAW

These Terms are governed by the laws of the State of Montana, United States, without regard to conflict-of-law principles, except where applicable consumer laws require otherwise.

Nothing in these Terms removes rights you may have under mandatory consumer-protection laws in your jurisdiction.
